AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and MyETutors (“Company,” “we,” “us,” or “our”), concerning your access to and use of the myetutors https://www.myetutors.com website as well as any related services (collectively, the “Service”).
You agree that by accessing the Service, you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.
1. DEFINITIONS
“Platform” refers to the MyETutors.com website and its underlying technology.
“Tutor” refers to an independent contractor who has registered on the Platform to offer tutoring services.
“Student” refers to a user who has registered on the Platform to receive tutoring services. Where the user is a minor, “Student” also refers to the parent or legal guardian responsible for the account.
“User” refers to any user of the Platform, including Tutors, Students, and visitors.
“Session” refers to a scheduled tutoring lesson between a Tutor and a Student facilitated through the Platform.
“Content” refers to all materials, including text, notes, graphics, images, audio, video, and any other information uploaded, posted, or shared on the Platform by Users.
2. ACCOUNT REGISTRATION
You must register for an account to access most features of the Service. You agree to:
Provide accurate, current, and complete information during the registration process.
Maintain and promptly update your account information to keep it accurate.
Maintain the security of your password and accept all risks of unauthorized access to your account.
Notify us immediately of any unauthorized use of your account.
You are responsible for all activities that occur under your account.
You must be at least 16 years old to create an account. If you are a minor, you may only use the Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
3. SERVICES AND PLATFORM ROLE
Role of My E Tutors: My E Tutors acts solely as a technology platform to connect Students with Tutors. We are not an employer of Tutors, nor are we a party to any contract between a Student and a Tutor. Tutors are independent contractors solely responsible for their own services, taxes, and professional conduct.
No Endorsement: The Platform provides profiles and information about Tutors, but we do not endorse, guarantee, or warrant the quality, accuracy, or suitability of any Tutor’s services. It is the Student’s responsibility to evaluate and select a Tutor.
4. TUTOR RESPONSIBILITIES
Qualifications and Conduct: Tutors represent and warrant that they possess the necessary qualifications, knowledge, and experience to tutor in the subjects they list. Tutors agree to provide services in a professional and competent manner, adhering to applicable educational standards.
Independent Contractor Status: Tutors are independent contractors and are responsible for their own schedule, methods, and materials. Tutors are not entitled to employee benefits and are solely responsible for their own income tax obligations.
Prohibited Conduct: Tutors must not:
Misrepresent their qualifications, identity, or experience.
Solicit payments outside of the Platform.
Share personal contact information with Students for the purpose of circumventing the Platform.
Engage in any unlawful, fraudulent, or inappropriate conduct with Students.
5. STUDENT AND PARENT RESPONSIBILITIES
Selection of Tutor: Students and Parents are solely responsible for selecting a Tutor and for the decision to use a Tutor’s services.
Session Preparation: Students are expected to be prepared for scheduled Sessions and to treat Tutors with respect.
Parental Supervision: Parents or guardians of minor Students are responsible for monitoring their child’s use of the Platform and their interactions with Tutors.
6. BOOKINGS, PAYMENTS, AND CANCELLATIONS
Booking: Sessions are booked through the Platform’s scheduling system.
Payment: All payments for tutoring services must be processed through the Platform. You authorize us to charge your provided payment method for the fees associated with the Sessions you book.
Pricing: We reserve the right to change our pricing at any time.
Cancellation and Rescheduling Policy:
Students may cancel or reschedule a Session without charge if done more than 12 hours before the scheduled start time.
Cancellations made less than 121 hours before the scheduled start time may result in the Student being charged for the full Session.
If a Tutor is late or misses a Session without notice, the Student will receive a full refund or credit.
Specific cancellation policies may be set by individual Tutors and will be displayed at the time of booking.
7. INTELLECTUAL PROPERTY
Platform IP: The Service, including its original content, features, functionality, source code, and design, are owned by My E Tutors and are protected by copyright, trademark, and other intellectual property laws.
User-Generated Content: By posting or sharing Content on the Platform, you grant My E Tutors a non-exclusive, worldwide, royalty-free license to use, display, and reproduce such Content solely for the purpose of operating and providing the Service.
Tutor Materials: Tutors retain ownership of the original educational materials they create. However, by posting them on the Platform, they grant MyETutors the license described above and grant the students they tutor a license to use those materials for their personal educational purposes.
Prohibited Use: You may not copy, modify, distribute, sell, or lease any part of our Service without our explicit written permission.
8. CODE OF CONDUCT AND PROHIBITED USES
You agree not to use the Service:
For any unlawful or fraudulent purpose.
To harass, abuse, intimidate, or harm another person.
To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “spam,” or any other similar solicitation.
To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
Service “As Is”: THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Academic Results: WE DO NOT GUARANTEE ANY SPECIFIC ACADEMIC RESULTS, GRADES, OR EDUCATIONAL OUTCOMES FROM THE USE OF THE TUTORING SERVICES.
Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYETUTORS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU HAVE PAID US IN THE LAST SIX MONTHS.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless MyETutors and its affiliates from and against any claims, damages, costs, liabilities, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. TERMINATION
We may suspend or terminate your account and access to the Service at our sole discretion, at any time and without notice, for conduct that we believe violates these Terms or is harmful to other Users, us, or third parties, or for any other reason. Upon termination, your right to use the Service will immediately cease.
12. GOVERNING LAW AND DISPUTE RESOLUTION
Governing Law: These Terms shall be governed by the laws of [State/Country], without regard to its conflict of law principles.
Informal Resolution: You agree to attempt to resolve any dispute informally by contacting us at [legal@myetutors.com] before initiating any formal proceeding.
Binding Arbitration: Any dispute arising from these Terms shall be finally settled by binding arbitration in accordance with the rules of Arbitration Bar of India in Panchkula, Haryana/India. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
13. MISCELLANEOUS
Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service.
Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Changes to Terms: We reserve the right to modify these Terms at any time. We will notify you of changes by updating the “Last Updated” date. Your continued use of the Service after any change constitutes your acceptance of the new Terms.
